Products Liability/Mass Torts
Defective or dangerous products lead to thousands of injuries and deaths every year in the U.S. Product liability refers to a manufacturer or seller being held liable for placing a defective product into the hands of a consumer. The law requires that a product meet the ordinary expectations of the consumer, and when a product has an unforeseen defect or danger, the product cannot be said to meet the ordinary expectations of the consumer. When bringing forth your concern for a product liability case, ask yourself two questions:
Is the Product Defective?
As a general rule, the question central to any product liability case is whether the product is in fact defective. There are a number of ways in which a product can be defective. If a product is defective in the way that it is marketed, manufactured, or designed, and someone is injured as a result of that defect, then the manufacturer, distributor and/or seller of the product are liable, or responsible for consequences of the defect.
Is the Product Unavoidably Unsafe?
An unavoidably unsafe product is not necessarily a product that is by its nature dangerous. Rather, it is a product that is incapable of being made safe for its intended and ordinary use. Courts generally look at four criteria in making the determination: the manner in which the product was prepared, the manner in which it was marketed, the utility of the product compared to the risk it poses and whether there are any alternatives to the product available. The most widely recognized category of products is prescription drugs. Notable prescription drug cases for products liability include Accutane, Avandia, Gardasil, Reglan, and YAZ/Yasmin.
